Paco, significa que não é preciso freqüentar a escola, seja no ensino fundamental ou médio. Basta apenas ter 18 anos completos na data da prova e atingir a pontuação necessária.

E o decreto-lei 2.848, como que ficou? Isso é que me desanimou....

Do ponto de vista criminal, o fato de deixar uma criança fora da escola não enseja, por si só, o crime de abandono intelectual. Até mesmo porque a instrução primária não ocorre apenas na escola. Tipificar como crime não matricular criança em escola é uma construção jurisprudencial.
